if it's for informational purposes only?
3. Do you believe the Fountaindale Library really have a trademark?

ReplyDeleteIt is possible to use trademarked images as part of fair use. So you can use a name logo, and picture as part of a news story or commentary. Their argument might be that you used the logo in a way that wasn't covered by fair use. Maybe they felt that the use of the logo implied that the board was endorsing The Number Crunchers.
I can't read the lawyer's mind, but it does seem odd that they didn't provide their reasons why the use of the logo was in violation. You could ask for clarification. At the very least it will be more billable hours, and the board might think twice before spending more money on this complaint.
Overall, be carefully when picking your battles, and make sure things are in order before getting into a battle.

ReplyDeleteI wish Claar and his goons would disappear. They are all irritants. Kind of like pink-eye. The only way to get rid of it is medication. When will the authorities come in and take care of this virus.
ReplyDeleteBullying is a tactic that this group is prone to use. Many citizens live in fear of Claar and his minions. Now that they have swept the election they have are going into attack mode. It's a travesty that they are trying to stifle free speech. Does the Patch use their name or logo in the same way?
ReplyDeleteDear Number Crunchers. I am sorry that you had to receive that but you do have Czar Claar worried. You achieved a lot of votes with your campaign in a small amount of time, so with real planning, a good campaign manager and strategy you will beat them next time. I say fight it with or without a lawyer and if you need funds for an attorney ask and we shall give. I am expecting a letter soon from Tressler to remove the image of Claar I have on the hammer and sickle displayed in my family room.

ReplyDeleteIt seems like the Tressler Law Firm should learn a little about copyright law before they threaten to sue people under it. Registered trademarks like a logo carry a registration mark ®; and trademarked names or lines carry a ™. More specifically logos have to be registered with the United States Patent and Trademark Office a quick search of their site shows know listing whatever for the Fountaindale Library District.

Let residents be aware of this Number Crunchers website. 2013 should be the year for a successful change in the Bolingbrook government leadership. We should plan this well in order for it not to fail like the previous election.
